Writ challenges constitutionality of Article 70

A writ petition challenging the validity of Article 70 of the constitution, which mandates the disqualification of a Member of Parliament for voting against their party, was filed in the High Court on Wednesday (October 23). 

Supreme Court lawyer Advocate Md Yunus Ali Akand submitted the petition, naming the Secretary of Law, Justice and Parliamentary Affairs, the Secretary of the Parliament Secretariat, and other relevant parties as defendants.

Article 70 states that if an MP elected under a political party either resigns from the party or votes against it in Parliament, their seat will be declared vacant, though they remain eligible for future elections.
