SC to hear EC’s appeal against DNCC by-polls stay Feb 8

The Appellate Division of the Supreme Court (SC) on Monday set February 8 for hearing an appeal against a stay imposed by the High Court on holding by-polls to Dhaka North City Corporation (DNCC).

Chamber Judge of the Appellate Division Justice Hasan Foez Siddique set the date and sent the matter to the apex court full bench for further hearing.

"The chamber judge court has sent the matter to the Appellate Division full bench and set February 8 for holding the hearing," said advocate Touhidul Islam, counsel for Election Commission (EC).

The High Court on January 17 stayed for six months the Dhaka North City Corporation by-polls, which was scheduled to be held on February 26.

The HC also issued a rule asking the EC to explain why the court shall not declare the schedule for the by-polls beyond the legal purview.

EC filed the appeal with the court of chamber judge of the Appellate Division on February 1.
