Judicial power of executive magistrate Ayesha suspended

Dhaka District Executive Magistrate Ayesha Huq has been directed to refrain from the judicial activities due to violation of law in case of giving verdict.

The Judge of Dhaka Speedy Trial Tribunal-4, Abdur Rahman Sardar, on Tuesday passed the order.

The court also directed the Deputy Commissioner of Dhaka and Dhaka District Magistrate to stop Ayesha Huq from judicial functions in order to ensure that the people do not face injustice.

According to the source, a person, named Alauddin filed a case related to land in Dhaka Executive Magistrates Court on May 10, 2012. Later, the court directed the police of Vatara police station to investigate into the case. At the end of the investigation, the police sent the report to the court verifying the authenticity of the incident.

The court issued a notice to the defendants to answer about the matter as the authenticity of case was found. As per direction of the notice, the defendants appeared before the court to answer the matter and they did not appear in the court anymore. Following to this, three people including plaintiff witnessed the court.

However, on July 17, 2016, Ayesha Huq dismissed the case violating judicial rule.

Generally, the date of verdict is fix after the completion of witness function. But Ayesha Huq dismissed the case without following the proper judicial way.

After the dismissal of the case, Plaintiff Alauddin filed a Revision case (874/16) of Judge Court against the dismissal of the case on January 17, 2016.  Then the case handed over to the Speedy Trial Tribunal. Then, the tribunal has given the verdict on Tuesday.

In this regard, Assistant officer Md. Hassan told Jago News, “Tribunal suspended the judicial power of Ayesha Huq due to violating proper judicial procedure in case of giving verdict”.
