Mobile court to continue for 3 more weeks
The Appellate Division of the Supreme Court on Tuesday extended for three more weeks the stay of the High Court order that declared illegal running mobile courts by executive magistrates.
A five-member bench led by Acting Chief Justice Abdul Wahhab Miah passed the order after hearing on the government appeal for staying the High Court verdict.
Barrister Hassan SM Azim appeared before the court on behalf of the writ petitioners while Attorney General Mahbubey Alam represented the state in the court.
On May 11, the High Court declared mobile court illegal and contradictory to the Constitution.
The court declared section 5, which empowers an executive magistrate to conduct mobile court, and sections 6(1), 6(2), 6(4), 7, 8(1), 9, 10, 11, 13 and 15 of the Mobile Court Act 2009 illegal and contradictory to the Constitution and independence and supremacy of the judiciary.
