Service rules for lower court judges: State gets time till Oct 8

The Appellate Division of the Supreme Court today granted the state time till October 8 for finalising and publishing gazette on service rules and conduct for lower court judges.

A full bench of the Appellate Division headed by Chief Justice Surendra Kumar Sinha came up with the order accepting a time plea from Attorney General Mahbubey Alam.

Earlier on July 30, the apex court set today for passing order on the matter.

The Appellate Division full bench, led by Chief Justice Surendra Kumar Sinha, set the date after holding hearing on the matter.

On July 27, Law Minister Anisul Huq handed him the draft of the service rules.

Commenting on the draft, the chief justice said it was not made as per the advice made by the Appellate Division.

“We are not accepting it and will talk with the government in this regard”, Justice Sinha said on that day, adding that the discussion could be held with the law minister, the attorney general and any other government expert by the end of the current week.

The apex court on July 23 allowed one more week to the state for finalising and subsequently publishing the gazette on service rules and conduct for lower court judges.

The law minister on July 20 expressed his optimism that the gazette would be finalised this week. On July 27, he also called on the chef justice at his office at the Supreme Court and handed him the draft of the gazette.

Following handing over of the draft, Huq told reporters that as per rules the chief justice would go through the draft and send it to the President along with his recommendations, if any.
