Decision on review after consultation with government: AG
Attorney General Mahbubey Alam said decision on whether to file a plea to review today`s apex court judgment against the 16th amendment to the constitution, will be taken after consultation with the government.
“Now a void is created in terms of way to remove apex court judges from their posts. I am very disappointed over this judgement,” the chief state counsel said.
Mahbubey Alam came up with the observations while talking to newsmen at his office as the Appellate Division of the Supreme Court this morning scrapped a state appeal against the High Court verdict that had declared the 16th amendment illegal to the constitution.
A seven-member apex court bench led by Chief Justice Surendra Kumar Sinha passed the order around 10:35 am.
On June 1, the apex court concluded hearing on the state appeal against High Court verdict that had declared illegal the 16th amendment to the constitution, which had empowered parliament to remove judges.
The attorney general, however, said the verdict proves once again the fact that rule of law is prevailing in the country.
“The judiciary is free and that is why it was able to pass such judgement,” Mahbubey Alam added.
Meanwhile, Law Minister Anisul Huq refrained himself from making any comment about today`s judgment, saying it would not be appropriate to pass any remark before going through the full text of the verdict.
