The Chamber Court of the Appellate Division in the Supreme Court has upheld the High Court order granting bail to former Chattogram Police Superintendent Babul Akter in the murder case of his wife Mahmuda Khanam Mitu.
Chamber Judge Md Rezaul Haque passed the order on Wednesday, December 4, after a hearing on a petition filed by his father-in-law Mosharraf Hossain seeking a stay order on his bail.
As a result, there is no bar to his getting released from jail, said his lawyers.
On November 27, the High Court, HC, has granted bail to Babul Akter the case.
Earlier on August 18, the court of Chattogram’s 3 Additional Metropolitan Sessions Judge Md Jashim Uddin rejected his bail petition.
Lawyer and family sources said Babul Akter has been in prison for more than three years in three cases but the allegations against him have not been proven. In the three cases, he earlier secured bail.
On March 13, the court of Chattogram’s 3 Additional Metropolitan Sessions Judge Md Jashim Uddin ordered to frame charges against former SP and six others.
The six other accused are Md Motaleb Mia alias Wasim, Md Anwar Hossain, Ehteshamul Haque alias Bhola, Shahjahan Mia, Md Kamrul Islam Shikder alias Musa, and Md Khairul Islam alias Kalu.
On June 5, 2016, Mitu was shot and stabbed to death on the way to pick up her son from a school bus on OR Nizam Road in Chattogram city.
Later, SP Babul lodged a case against unidentified people with the Panchlaish police station in Chattogram in this connection.
Later, Mitu’s father Mosharraf Hosen filed a case with the Panchlaish police station where Babul Akter was made main accused.
