SC accepts state appeal against HC verdict on mobile court

The Appellate Division of the Supreme Court (SC) today accepted three leave to appeal petitions filed by the state against a High Court order that declared mobile courts run by executive magistrates were illegal. 

“The apex court allowed the leave to appeal petitions and set February 13 for holding hearing on the matter. The High Court order will remain stayed until the disposal of those appeals. The court also ordered to submit the summary of the appeals within three weeks,” said deputy attorney general Motahar Hossain Saju.

A five-member Appellate Division bench headed by Acting Chief Justice Md Abdul Wahhab Miah passed the order this morning, reports BSS.

On May 11, 2017, the High Court passed the order, declaring some 14 sections and sub-sections of the concerned act unconstitutional. The full text of the 64-page verdict was released by the High Court on June 7 in last year.

Law and home ministries filed the three leave to appeal petitions after the High Court's verdict was passed.
