The Appellate Division of the Supreme Court (SC) today issued a rule allowing continuation of collecting surcharge from the rich people of over Taka 2 crore.
The five-member Appellate Division bench, headed by Acting Chief Justice Md. Abdul Wahhab Miah, passed the order upon hearing a leave to appeal petition filed by several businessmen challenging the High Court verdict.
But, the court granted the leave to appeal allowing the businessmen to file an appeal against the HC order with the Appellate Division.
Four other members of the bench are: Justice Syed Mahmud Hossain, Justice Muhammad Imman Ali, Justice Hasan Foez Siddique and Justice Mirza Hussain Haider.
The High Court (HC) on January 12 in 2016 passed a judgment declaring collection of additional tax as surcharge from the rich people is constitutional. Then, some businessmen filed a leave to appeal against the verdict.
Lawyer Fida M Kamal moved for the businessman while deputy attorney general Rashed Jahangir Shuvro for the state.
National Board of Revenue (NBR) has been collecting surcharge from the persons with wealth of over Taka 2 crore in line with income tax ordinance. The surcharge has been restructured in four levels from the fiscal year 2015-2016.
The people with properties of Taka 2cr to 10cr give 10 percent surcharge on income while owners of Taka 11cr to 20cr give 15 percent surcharge, owners of Taka 21cr to 30cr give 20 percent surcharge and owner of over Taka 31cr give 25 percent surcharge.
