The legal battle between Karisma Kapoor and estranged husband Sunjay Kapoor has just turned uglier. The actress has now filed a criminal complaint against Sunjay and his mother alleging physical and mental harassment from their end. The complaint filed under Section 498 (A) of IPC is only for physical and mental harassment and has nothing to do with dowry demands as is being speculated.Confirming the same, senior counsel Sanjog Parab who is representing Karisma in the matter told IndianExpress.com, “The complaint has been filed for physical and mental harassment and cruelty. It has got nothing to do with dowry because there is no issue of money at all. It is purely a question of physical and mental harassment. We believe as I have been instructed by my client that the gentleman (Sunjay) while his marriage is subsisting with Karisma, has been staying with another paramour in his own matrimonial house along with that woman’s child.”When asked why the complaint of harassment was not filed by Karisma earlier, Adv. Parab said, “She approached me and we took a call. At the end of the day, the rights are available to her. Now what has happened is he (Sunjay) renegade from his consent terms according to my client. He backed off from the consent terms after nearly 18 months. So what is a mother who is left with two kids supposed to do? Eventually she has taken a call and she has the right to file the case and she has filed it.”Karisma has claimed for maintenance of Rs. 10 lakh per month for both kids. also claimed maintenance for her two kids under the Domestic Violence act. ” The money she is claiming is not for her but for her children. We are very clear on that,” said Adv. Parab.Furthermore, there is also a restraint order passed by the Hon’ble court effective till March 17 against Sunjay that will prevent him from taking his two kids out of Mumbai jurisdiction without due process of law.
